1. Acceptance of Terms

By accessing and using BacktestMe ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

BacktestMe provides a web-based platform for backtesting trading strategies across multiple markets including forex, cryptocurrencies, stocks, and commodities using historical market data. The Service allows users to:

• Create and save trading strategies
• Run backtests against historical data across multiple markets
• View performance metrics and analytics
• Export backtest results

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating an account
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities under your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purposes
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Upload malicious code or viruses
• Scrape or harvest data from the Service without permission
• Abuse rate limits or attempt to bypass security measures

5. No Financial Advice

You acknowledge that trading forex, cryptocurrencies, stocks, commodities, and other financial instruments involves substantial risk of loss and is not suitable for all investors. You should not trade with money you cannot afford to lose. You agree to conduct your own research and consult with licensed financial professionals before making any investment decisions.

6. Data Accuracy

While we strive to provide accurate historical market data, we do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service. Market data is sourced from reputable third-party providers and may contain errors or delays.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by BacktestMe and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of the trading strategies you create. However, if you choose to make a strategy public, you grant us a non-exclusive license to display and share that strategy with other users.

8. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be available 100% of the time. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions
• Force majeure events

9. Limitation of Liability

To the maximum extent permitted by law, BacktestMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any trading losses or investment losses of any kind
• Any unauthorized access to or use of our servers and/or any personal information
• Any bugs, viruses, or other harmful code
• Any errors or omissions in any content, data, or backtest results
• Trading losses based on strategies developed using the Service
• Any reliance on historical data, backtest results, or performance metrics
• Any failure to achieve expected returns or profits

IN NO EVENT SHALL BACKTESTME'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO BACKTESTME IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

BacktestMe makes NO GUARANTEES, WARRANTIES, OR REPRESENTATIONS of any kind regarding:

• The accuracy, reliability, or completeness of market data
• The accuracy of backtest results or calculations
• The profitability or success of any trading strategy
• Future performance based on historical results
• The achievement of any specific investment returns
• The suitability of any strategy for your specific circumstances
• Uninterrupted or error-free operation of the Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. User Representations and Warranties

By using the Service, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into this agreement
• You understand that trading involves substantial risk of loss
• You are using the Service for educational purposes only
• You will not rely solely on backtest results for trading decisions
• You will conduct your own independent research and due diligence
• You will consult with licensed financial professionals before making investment decisions
• You understand that past performance does not guarantee future results
• You accept full responsibility for your trading decisions and outcomes
• You will comply with all applicable laws and regulations in your jurisdiction

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Malaysia, and you hereby irrevocably consent to the personal jurisdiction and venue therein.

Note: Users from different jurisdictions remain subject to their local laws and regulations regarding trading activities.

17. Complete Agreement

These Terms of Service, together with our Privacy Policy and Risk Disclaimer, constitute the entire agreement between you and BacktestMe regarding the use of the Service, superseding any prior agreements between you and BacktestMe relating to your use of the Service.
